Arbitrator

Arbitrator (Rent Review) - A rent review clause should include a provision as to how the review will be settled, in the avoidance of agreement between the parties. This is usually by determination by a third party surveyor and there will be a route for a surveyor to be appointed if one can not be agreed.

There should also be guidance as to how that independent surveyor should act. As an arbitrator, they can ask for submissions from the two parties and make the decision based on those submissions only. This is very different to acting as an Expert, where the surveyor can still ask for representations, but can also rely on his knowledge and experience of the local market.
